In the general terms and conditions, the following definitions apply:

Weight consultant: Alexandra Bone

Client: The person to whom the Weight consultant provides advice and guidance or their legal representative

Practice address: The location where the guidance/Consultation of the Weight consultant is exercised

Consultation: an appointment in which the Weight consultant provides Client advice and guidance in person, via telephone or video conference

Package: A Package of multiple Consultations where a reduced rate applies

Event: All types of events are covered below. Examples are workshops, lectures, day events, etc.

Physician: The GP or specialist with whom the Client is under treatment

 

General

The Weight consultant gives advice to the Client at the Practice address, unless mutually agreed otherwise. It is also possible to receive advice by email, phone or Skype. This is mutually agreed beforehand.

Any change to the Practice address will be immediately communicated to the Client or the Weight consultant.

 

Basis

The Weight consultant can advise and guide the Client on an individual base as well as on the base of referral by a physician. In the latter case, the Weight consultant shall keep the referring physician informed of the progress. Data of the Client will not be provided to third parties without the consent of the Client and the physician. Advice and guidance takes place through Consultations, workshops or other forms of activities. Consultations can be agreed upon individually or purchased through a Package with a reduced rate. When a Package is agreed, the last Consultation of the Package must be made within one year after the start of the intake/first Consultation. If this is not the case, the unused Consultations will expire.

 

Cancellation

If the Client is unable to attend a Consultation at the agreed date and time at the Practice address, the Client must inform the Weight consultant as soon as possible. If the Client gives notice to the Weight consultant within 24 hours of said time, or does not provide such notice, the Weight consultant shall be entitled to charge the costs for the relevant Consultation to the Client.

Should the Client decide not to participate in an individual Consultation or an (online) Package after registration, the following cancellation scheme applies:

Cancellation longer than one month (30 days) before the start of the intake/first Consultation: costs are fully refundable.

Cancellation between one month (30 days) and one week (7 days) before the start of the intake/first Consultation: 50% of the cost is refunded.

Cancellation less than one week (7 days) before the start of the intake/first Consultation: the costs are not refundable.

For Consultations on a day following a Sunday or recognised public holiday, the 24-hour period shall be deemed to start at 18:00 (6 PM) on the last preceding ordinary working day. On a regular Monday, the deadline is therefore at 18.00 (6 PM) on the preceding Friday.

 

Termination of guidance (Consultation, (online) Package)

The guidance is terminated if:

-The goal(s) has(ve) been reached.

-Referral to GP or other expert is necessary (cause of the complaint is outside the field of expertise of the Weight consultant)

-The Client wishes to terminate the guidance, however if the Client wishes to terminate during a started Package, the Client must pay the costs up to and including the week of cancellation, at the rates of individual Consultations instead of the reduced Package rate. Previously paid amounts for subsequent weeks will be refunded to the Client, minus the difference in tariff of individual Consultations and Package rates for the already enjoyed Consultations.

Prior cancellation of participation in an Event

If the Weight consultant cancels the booking due to cancellation of the Event, the paid amount will be refunded to the Client.

If Client cancels 0 to 14 days before the start of the Event, the Client will receive a credit for the total amount paid. This credit can be freely spent at the Weight consultant for a year after date Event.

If the Client cancels more than 14 days before the start of the Event, the Client will receive the full refund.

 

Privacy

By enjoying services offered by the Weight consultant, Client agrees to the privacy policy of Slim Life.

Rates

The Weight consultant shall inform the Client orally or in writing of the applicable rates before the commencement of the guidance. These rates include VAT or other legal charges if and to the extent that they should be charged. The Weight consultant is entitled to carry out price changes. If a Client has already paid for a service such as a Package, Consultation or Event, no price change will apply to said service. 

 

Intellectual rights

The Weight consultant shall at all times retain all rights to its opinions, advices, tips, plans, documents, e-books, recipe bundles and images and/or the related information and knowledge of matters, even when costs have been charged to Client or improvements have been made afterwards, whether or not on the Client’s request. The aforementioned items may not be copied, in whole or in part, without the written consent of the Weight consultant, other than for internal use by the Client, nor handed out or otherwise disclosed, nor be used or made available by the Client other than for the intended purpose for which they were provided by the Weight consultant.

 

Payment

Payment must be made by bank transfer. The Client will receive an invoice for the Consultations provided. The Weight consultant is entitled to refuse a Consultation if the Client has not made the payment. 

The Client must pay the invoice within 7 days of invoice date, but no later than the last working day before the start of the intake/first Consultation. If the payment deadline is exceeded, the next Consultation will be postponed until after receipt of the payment.

With every exceedance of 14 days, the Weight consultant is entitled to increase the invoice amount by € 5 administration costs.

If the invoice is not paid within 30 days after invoice date, the Weight consultant shall be entitled to charge statutory interest on the amount due retroactively from the first day of chargeability, as well as all costs relating to collection of the relevant claim, expressly including costs for collection by a debt collection agency and court fees.

 

Right to suspend performance

The Weight consultant has the right to suspend agreed services such as Consultations, Events, activities etc if Weight consultant is temporarily prevented from fulfilling her obligations due to circumstances which are outside her sphere of influence or of which she was not aware at the start of the agreement or due to illness. If the fulfilment of obligations is permanently prevented, the agreement may be dissolved for that part that has not yet been fulfilled. Previously paid but not yet enjoyed Consultations will be refunded to the Client. Neither party shall be entitled, in that case, to reimbursement of the damage incurred as a result of the dissolution.

 

Liability

The advice and/or the guidance of the Weight consultant is, by its nature, result-oriented without guaranteeing that result. The Weight consultant excludes any liability in respect of damage or injury or illness arising out of or in connection with the Client following the opinions, guidance or advice provided by the Weight consultant, unless there is intent or gross negligence on the side of the Weight consultant, on the understanding that this liability is limited to the amount against which the Weight consultant is insured. Therewith the following restrictions must be taken into account. No compensation will be applicable for business damage, loss of income etc caused by whatever cause. For damage caused by intent or gross negligence by third parties, the Weight consultant is never liable. If the insurer of the Weight consultant does not pay out for any reason, the liability of the Weight consultant shall at all times be limited to a maximum of twice the rate of one Consultation. The Weight consultant is not responsible or liable for the consequences of incorrect information resulting from an unknown and/or withheld or concealed health aspect.

 

Applicable law and choice of forum

Only the civil court with jurisdiction in the place of the registered office of the Weight consultant is entitled to take note of disputes. All agreements shall be governed by Dutch law.
